Terms of Service

Using our products and services

Wealth Create Australia or Wealth Create OpCo Pty Ltd (ACN 674 856 163, ABN 84 674 856 163) (we, us or our) operate websites, newsletters, quizzes, tools, events, marketing, advertising and other services (the Services). By accessing, using or receiving the Services, you agree to these terms and conditions and our Privacy Policy (together, the Terms).

Your use of the Services does not grant or transfer any rights, title or interest to you, and is at your own risk. While using the Services, you must not do anything unlawful or that we deem to be inappropriate.

We may at any time change, suspend or stop providing any element of the Services or terminate your use of or access to the Services without notice and without any liability.

If you do not agree to these Terms, you must immediately stop accessing, using or receiving the Services.

Your account

You may be required to create an account or provide your personal details to us (your Account) to access the Services. You must ensure any information you provide is accurate and current.  By providing your email address, you consent to our use of that address to send you any messages related to your Account or the Services, including any notices required by law.

Events purchases

Tickets may be purchased online and will be open to members (if applicable) and the general public on a first-come, first-serve basis. Tickets may be purchased through a third party ticketing platform (e.g. EventBrite or Humantix) and may be subject to third party terms and conditions of the platform on which we list the ticket. We reserve the right to decline your application to attend the event at our absolute discretion. In purchasing a ticket, you agree that:

  • your booking at the event is confirmed once you have received an email notification and receipt from us or via a third-party platform used by us;

  • entry to the event will be permitted on presentation of your ticket or booking confirmation;

  • you must pay the Price (including GST) for your ticket booking and any credit card surcharge or administration fees as specified on our website and in accordance with any terms;

  • ticket prices may be subject to change and we will use reasonable commercial endeavours to inform you of any changes;

  • if you pay the price under any agreed instalment plan we offer, all payments in the instalment plan must be made on time. If any scheduled payment is over 5 business days late (Due Date), you will forfeit your place at the event and any proportion of the price you have paid prior to the Due Date

If you cancel your tickets with at least 14 days’ notice (Cancellation Notice Period), we will give you a refund of your ticket price, less any booking and handling fees, through our ticket booking platform.

Event cancellation, rescheduling or postponement

This clause applies if an event is cancelled, rescheduled or postponed.

If the event is postponed, you may notify us in writing no later than 14 days after the originally scheduled event Date to obtain credit or a refund for the ticket price to put towards another one of our events that occurs within 12 months of the originally scheduled date of the postponed Event (Refund Request). If we do not receive a Refund Request, your ticket will be automatically transferred to the new date for the postponed event.

If the Event is cancelled due to a Force Majeure event you will receive either a credit of the ticket price to put towards another one of our Events or a refund, at our absolute discretion.

If the event is cancelled for any reason other than a Force Majeure Event, you may notify us in writing no later than 14 days after the original scheduled event date to obtain a refund of the ticket price. If you fail to request a refund, you will receive credit for the ticket price 14 days after the scheduled date of the event to put towards another one of our Events, and no further refunds will be issued.

We will use reasonable commercial endeavours to notify you of any cancellations, rescheduling or postponements of the event through email, however it is your responsibility to ascertain whether an event has been cancelled, rescheduled or postponed. We do not guarantee that you will be notified of the cancellation, variation, rescheduling or postponement before the date of the event.

Any refund or credit issued to you under this clause will be your sole remedy for a postponement or cancellation of the Event and we will have no further liability to you in respect of any cancellation, rescheduling or postponement of an Event for any reason. If you require travel insurance or other insurance, you are responsible for obtaining this, noting that the Event ticket does not cover any such insurance.

For the purposes of this clause, a Force Majeure Event includes any act of god, terrorism, war, civil unrest, strike or labour dispute, lack of transportation, breakdown, labour or material shortage, blockade or embargo, supplier failure, epidemic or pandemic (including the COVID-19 pandemic), government restriction or recommendation, extreme weather, earthquake, drought, fire, flood, explosion, natural disaster and/ or any other event, cause or circumstance beyond our control.

 

Variation of event

We reserve the right to vary the event.

 

Variations are made at our sole discretion and may include (without limitation):

  • moving the event so that it will take place on an online platform (such as Zoom) instead of in-person;

  • amending the schedule or format of the event, including cancelling networking sessions; 

  • replacing planned speakers.

If the event is varied in accordance with this clause, no refund or credit will be provided under these circumstances. We will use reasonable commercial endeavours to notify you as soon as reasonably possible of the variation details and specifications if this is to occur.

 

Event conduct 

During the event, you agree to behave in a professional and appropriate manner. You acknowledge and agree that cameras, audio and video recorders may not be permitted at certain events and hereby permit us to film you and use that footage in our social media and any promotional material. We reserve the right to refuse entry or require you to leave the event if your behaviour is deemed unacceptable at our absolute discretion.

 

Photography and recordings

We may take photographs (Photographs) and recordings (Recordings) at the event. You agree that:

  • accepting these Terms means you consent to being filmed or photographed by us (or our representatives) and for us to use your name, likeness, image and/ or voice in such photographs or films for the purposes of promoting our events, services and products;

  • no remuneration is payable to you for our use of such Photographs and Recordings;

  • you release us from any infringement or violation of personal and or property rights of any sort based on our use of such Photographs or Recordings;

  • we are not obligated to use any Photographs or Recordings; and

  • you may request for us not to use a particular Photograph or Recording, however we are under no obligation to do so and any consent to your request will be at our absolute discretion.

Event disclaimer

In addition to our Disclaimer, you agree to attend our events on the basis that there are no outcomes guaranteed with respect to the results of our events, including (without limitation) in relation to any improvements in your financial literacy, your financial investments, your wealth, your net worth or your retirement plan or readiness.

Privacy

We may collect personal information about you in order to provide the Services or respond to your enquiries.  Our Privacy Policy provides further detail on how we use, and how you can access, that information.

While we care about the integrity and security of that information, we cannot guarantee that unauthorised third parties will never be able to defeat our security measures or use your information for improper purposes.

 

By providing information to us, you consent to the collection, use, storage and disclosure of that information as described in these Terms, and acknowledge that you provide that information at your own risk.

Intellectual property rights

Unless otherwise indicated, we own or license from third parties all rights, title and interest (including copyright, designs, trademarks and other intellectual property rights) in the Services and of the material (including all text, images, audio and video) made available on the Services (the Content).

Unless we authorise you in writing, you may use the Services and Content for your personal, non-commercial use only.

You may not modify, copy, distribute, transmit, publicly display, perform, reproduce, publish, adapt, edit, license, commercially exploit, create derivative works from, transfer, ingest, sell or otherwise commercially benefit from the Services or Content.

If you choose to share any comments or ideas related to the Services or Content, you agree your disclosure is without restriction and will not place us under any fiduciary or other obligation. You further acknowledge that we do not waive any rights to use similar or related ideas previously known to us, or developed by our employees, or obtained from sources other than you.

Content

The Content is provided for your general information only and should not be interpreted as professional advice.  You should seek independent professional advice related to your specific circumstances. We are not liable for any financial, legal or other decisions based on your use of the Content.

We may link to websites or other services operated by third parties. We do not endorse and are not responsible for the content on those linked websites, and any access is at your own risk.

Referrals

We may refer you to an AFS licensee or representative to provide you with the type of financial services or services you require. You acknowledge that we may receive a benefit by way of commissions and other fees for referring you to an AFS Licensee or representative as a result of the referral or any subsequent services provided to you. Notwithstanding our referral to an AFS licensee or representative, you acknowledge that we are not recommending you invest in a financial product or class of financial products.  

Advertising

The Services may include advertising or other messaging provided by third parties (Advertising).  

We do not endorse or recommend any third party and ask that you contact that third party directly if you have any queries or concerns regarding their Advertising.  You agree not to make any claim or complaint against us in relation to any Advertising.

Promotions and competitions

Additional terms and conditions may apply to certain promotions and competitions.  You need to agree to those terms and conditions to participate and, in case of any inconsistency, those terms and conditions will prevail over these Terms.

Other

We may use our discretion to vary these Terms in individual circumstances.

 

Warranties and disclaimers

To the maximum extent permitted by law, we make no warranties or representations about the Services or Content, including but not limited to warranties or representations that they will be complete, accurate or up-to-date, that access will be uninterrupted, error-free or free from viruses, or that the Services will be secure.

Liability

To the maximum extent permitted by law, in no event shall we (and our affiliates, agents or representatives) be liable for any direct and indirect loss, damage or expense – irrespective of the manner in which it occurs – which may be suffered due to your use of the Services or Content, as a result of or in connection with the inaccessibility of the Services, or if the Content is incorrect, incomplete or not up-to-date.

 

We (and our affiliates, agents or representatives) are not liable for any loss or damage caused or contributed by, whether due to negligence or otherwise, the use of, or reliance on, the Services, the information provided directly or indirectly by the use of this website or loss of data or profits arising out of, or in connection with, the use of this website or this website being unavailable for any reason.

 

Severability

If any provision of these Terms is deemed to be invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which will remain in full force and effect.

No waiver

No waiver of any term of these Terms shall be deemed to be a further or continuing waiver of such term or of any other term. Any failure to assert any right under these Terms shall not constitute a waiver of such right.

Entire Agreement

These Terms contain the entire understanding and agreement between us in respect of its subject matter.

Governing law

These Terms and any issues arising under these Terms will be governed by and construed in accordance with the laws of Western Australia, Australia. You agree to submit to the exclusive jurisdiction of the courts of Western Australia, Australia.
